Terms of Services
CLIENT RESPONSIBILITIES
The client is responsible for providing architectural plans (CAD or PDF) suitable for use as backgrounds, any existing RCPs, interior design direction or inspiration imagery, and timely feedback at each stage of the engagement. Delays in providing this information or in responding to deliverables are not the responsibility of Delivered Lumens / Reveal Design Group and may affect the project schedule.
OPTIONAL ADDITIONAL PHASES
Most Delivered Lumens engagements conclude at the end of Schematic Design. If the client wishes to extend the engagement, Delivered Lumens / Reveal can provide full Design Development (DD) and/or Construction
Documentation (CD) services under a separate proposal. DD and CD services would include full CAD drawings and fully worked-out specific drawing details, dimensioning, specifications, etc.
NOT INCLUDED IN SCOPE OF SERVICES
This engagement is limited to the deliverables described in your proposal. The following are expressly excluded: on-site visits, construction administration, fixture aiming or focusing, photometric calculations, controls system design or programming, electrical engineering, code compliance calculations, submittal review, and as-built drawings. Any of these services may be available by separate agreement.
GENERAL TERMS AND CONDITIONS
1. Responsibility – It is understood that the consultant is responsible only for the visual aspects of the lighting and that all of the consultants’ specifications relate solely to the appearance of the lighting and not matters of structural soundness and/or safety. The consultant is not responsible for equipment failures and delays caused by manufacturers, contractors, shoppers, installers, or end users.
a. It shall be the responsibility of the fixture supplier and installing contractor to confirm that all specified fixtures are appropriate for installation in their indicated locations within the project and to bring any discrepancies to the attention of (Design Architect).
b. It shall be the responsibility of the electrical contractor to bring any discrepancies within the drawings and specifications to the attention of (Design Architect) for resolution prior to installation.
Approval –Altering the locations, quantity or types of lighting fixtures and lighting controls from those specified without the approval of Delivered Lumens shall remove Delivered Lumens from any liability that may be incurred by those lighting fixtures.
Use – The lighting design and the design of all custom fixtures created by Delivered is for use on this project only at this location only (as named in this agreement). The design(s)
remains the property of Delivered Lumens. Should the Client wish to use this design at other locations, Delivered Lumens shall provide a proposal for such auxiliary use of Delivered Lumens consultation and fixture design services.
Electrical Engineering – The consultant’s work does not replace the need for electrical, mechanical or structural engineering services. DL / Reveal is a lighting design consultant and is not licensed to provide electrical or other engineering services. The electrical engineer must review and approve DL/ Reveal’s plans, schedules and details and issue them as a part of the general building electrical plans.
Additional services – Revisions initiated or requested by the client that require DL/Reveal to modify a deliverable previously issued, or that substantially expand the character or quantity of the services described above, shall be considered Additional Services. Additional Services must be approved by the client in writing before such work commences and will be billed at the hourly rate for $150 per hour.
Termination – Either party may terminate this agreement on ten days written notice for any reason whatsoever. Client will compensate DL / Reveal for all services already performed, all reimbursable expenses incurred, and all goods obtained or ordered for Client pursuant to the agreement.
